The right to counsel means a defendant has a right to have the assistance of a lawyer in
court. If the defendant cannot afford a lawyer, the government must appoint one or pay the
defendant’s legal expenses. This right is part of the defendant’s right to a fair trial and is an
individual right. Unfortunately, this right is often not given to the individual as the government
is failing the constitution by not granting a right to counsel to every single defendant in every
single court room. It does not matter if the government grants a right to counsel to most
people. If it does not grant this right to every single person, no matter which court room they
are in and what petty crime they committed then the system itself is constitutionally deficient.
The problem is that this deficiency is hard to fully grasp because it is impossible to track every
single trial in every single court nationwide. However, with government resources and the
judge’s time wearing thin, this issue is becoming more present.
This brings us to the idea of ineffective assistance and the problem that many of the
poor class face daily. It is common that the government will grant right to counsel to a
defendant who can’t afford it, but in an inadequate manner. For example, the accused may be
given a lawyer who has too many cases or is being too underpaid to adequately defend the
accused with a strongly built case. The attorney is often times not independent of the courts
and prosecution, and does not have the resources and skills to adequately represent them. The
assigned lawyer is therefore not effective and the defendant only appears to be granted their
rights when in actuality their right for a completely fair trial is compromised.
