1. On May 15, Ted contacts Able Movers because he needs to move from his house in San Jose to
San Francisco the first week of June. Ted saw an Able Movers advertising flyer, which showed a
wide range of services and good testimonials from customers. Ted has also consulted other
movers, but Ted is impressed by the flyer. He also wants Able Movers to examine all the items
for the estimate because he wants Able Movers to pack them as needed. Able comes and says
the work should only take one day, and Able should provide the estimate by phone in a few
days. But Ted calls Able’s manager on May 25 and asks if Able is still going to do the job since it
has not yet provided the price. Able’s manager promises the work will start on June 2and
provide the estimate soon. Ted is happy that Ted and Able employees come on June 2 and start
packing. The next morning, Able Movers takes everything in the house to San Francisco, move
the items in and hand Ted the bill for $5,000. Ted calls Able’s manager and says the price it is
much higher than the estimates he had gotten from two other moving companies closer to
$3000. Able says this is because they had to use special packaging for Ted’s artwork, sculptures
and paintings, which took additional time and required special expertise. Able says their
expertise is described in the advertising flyer that Ted had seen.. Is there a contract? Does Ted
have to pay $5,000? Anything? Explain. 4 sentences
2. In August, Painter agrees to paint Laurie’s house in San Jose for $2,500 and promises to start
work on September 15, explaining the work will probably take 3-5 days. Painter starts work on
September 15, returns on September 16 and at noon, when Laurie comes home for lunch,
Painter tells her the work is taking longer than he expected so he will have to charge her $3500.
Laurie is upset but Painter shows her the work and she sees the work is good. Painter explains
that he underestimated the time involved because she has two balconies and painting those
took much more time. Laurie wants him to finish so she signs an invoice Painter provides, which
he also signs, agreeing to pay $3500. When Painter finishes, does Laurie have to pay him $2500
or $3500? Explain. (4 sentences)
3. Tom , Vice president of Apex Inc., has a telephone conference with Beth, Vice president of Beta,
Inc. on March 1, 2017, using videoconferencing recording to facilitate communication and
provide a record of the conversation. Tom agrees Apex will sell 5,000 commercial refrigeration
units to Beta Inc for $80,000, to be delivered to Beta’s warehouse in Phoenix, Arizona, on
November 29, 2017. Beth agrees and promises that Beta will pay the 80,000 no later than
December 20 by check. In October, Beth runs into Tom at an industry conference, mentions she
appreciates Apex’s business. Tom tells her Apex won’t be shipping the units because he just
made a better deal with another buyer. Nothing is shipped. Can Beta sue Apex for breach of
contract? Is the case strong or weak? Briefly explain (4 sentences).
